Foreword

The iangoo.fr and iangoo.com Web sites (hereinafter “the sites”) are the property of the private limited company SARL UNIVERS NUMERIQUES (hereinafter “UNIVERS NUMERIQUES”) in their entirety, together with all related rights. No reproduction, in full or in part, may be made without the prior written authorization of the owners. Hypertext links to the sites may be set up subject to prior authorization by e-mail.

Definitions

www.iangoo.fr and www.iangoo.com Web sites : the purpose of these Internet sites is to sell games on-line Client: user who has created an account on the www.iangoo.com. sites
User: an Internet user connected to the sites at www.iangoo.com .
Validation of order: firm and final confirmation of an order by the client implying full acceptance of these General Sales Conditions.

Purpose

These General Sales Conditions govern the contractual relations between UNIVERS NUMERIQUES and the Client and the conditions applicable to the purchase of products on our web sites.

Binding nature of these General Sales Conditions

Sale of the products supplied by UNIVERS NUMERIQUES shall be subject to these General Sales Conditions regardless of the Client’s nationality. By purchasing products via the www.iangoo.fr and www.iangoo.com sites the Client accepts these General Sales Conditions fully and without reservation. No stipulations or conditions appearing on the Client’s order which are in any way incompatible with these General Sales Conditions or add to them shall be binding on UNIVERS NUMERIQUES.

These General Sales Conditions shall take precedence over any other general or particular conditions not expressly approved by UNIVERS NUMERIQUES. Should UNIVERS NUMERIQUES choose at any time not to avail itself of any of these General Sales Conditions, this shall not be taken to mean that it will not avail itself of the same conditions in the future. UNIVERS NUMERIQUES reserves the right to amend these General Sales Conditions at any time. The resulting amended Conditions shall be applicable only to orders made subsequent to the amendments.

Products for sale on-line by downloading

The products on offer for downloading are those presented on the iangoo.fr and iangoo.com sites. UNIVERS NUMERIQUES will present them in the form of a video excerpt from each episode giving as accurate a picture as possible of the content. The Client shall use the products for his or her personal use only, as stipulated in the section on “Intellectual Property”.

The Client or User of the sites must have computer equipment that meets the minimum standards required to download and use the games, namely:

UNIVERS NUMERIQUES shall not be liable in the event of failure by the Client to fulfil these requirements.

Orders

Orders shall be placed exclusively by Internet via the www.iangoo.fr and www.iangoo.com sites. Before placing an order via the UNIVERS NUMERIQUES sites, the Client must first register on the site. This means opening a personal account. When you order a game, each step in the process is clearly explained on the Sites. The Client is able to verify the details and total price of the order and correct any errors before confirming and validating the order. The order is only registered after the Client has validated the payment and the bank has accepted the transaction. The time required to validate the order varies with the means of payment. UNIVERS NUMERIQUES declines all responsibility in the event of non-validation of the order, and the Client shall have no claim against it. A recap of the Client’s order is available in printable form. As soon as the order has been registered, the Client receives confirmation by e-mail containing the main details of the order, including the order number, the list of products ordered and a breakdown of the cost. UNIVERS NUMERIQUES will send the Client an invoice within 7 days from the date of the order. The contractual information will be in French and will be translated for information. The information provided by the Client when placing the order and in the confirmation thereof shall be the proof of the transaction. UNIVERS NUMERIQUES reserves the right to refuse an order from a Client with whom it has a problem regarding payment for an earlier order, until such time as the problem has been resolved.

Product availability

Products shall be available at the stated prices as long as they appear on the sites. The information given on the sites concerning the approximate duration of data transmission when downloading products is purely indicative. Data transmission times depend mainly on the speed of the Client’s Internet connection and any delays shall not entitle the Client to cancel the sale, refuse the merchandise or claim damages. Access to the service is permanent. It may, however, occasionally be suspended or limited by UNIVERS NUMERIQUES for upkeep, maintenance, updating the servers or exceptional interruptions, or to bring new tools or services into operation. UNIVERS NUMERIQUES shall not be held liable for any such interruptions in access to its services.

Prices

All prices of products offered for sale on the sites are in euros, including VAT, and in dollars.
Payment shall be by bank card or through a PayPal account. UNIVERS NUMERIQUES declines all responsibility for any error or inaccuracy in the conversion system used and for any difference between the total estimated cost of the order and the sum debited.
UNIVERS NUMERIQUES reserves the right to modify its prices at any moment, but all products will be invoiced at the prices applicable when the orders were registered. VAT is payable on all products delivered electronically from a European Union member State to a private individual in another European Union member State, at the rate applicable in the sending State, in this case France.

Security of payment

UNIVERS NUMERIQUES offers its Clients a secure means of payment by credit card on the Internet: PayPal PayPal uses a secure payment system that meets SSL and SET standards, the safest, most widespread system currently in use. Using this payment system requires no special software on the Client’s computer. The Client’s bank details are secured (to the ISO’s ISO 8583 standard) and routed directly to the payment organization without transiting via the UNIVERS NUMERIQUES sites. UNIVERS NUMERIQUES receives no bank details, the authorization being handled directly by PayPal. UNIVERS NUMERIQUES stores no bank details.

Delivery

The Client accesses the products by clicking on the download link on the “my account” page. An episode which has been paid for may be downloaded during a period of 8 days from the date of purchase. UNIVERS NUMERIQUES shall not be liable in the event of failure to download a product within that 8-day period. In that event a new order will have to be placed on the sites and a new payment made to gain access to the product and open a new 8-day download window.

24-month download insurance service:

This service guarantees the availability of a game for downloading for 24 months from the date of purchase. If the Client has to re-install software on a computer following a technical problem, for example, the products insured by this service can be re-installed by a simple click of the mouse using the information communicated at the time of purchase.

Complaints / Information

For any information, complaint or question concerning these General Sales Conditions or the products proposed on the sites, the Client is cordially invited to contact the UNIVERS NUMERIQUES customer service department, stating the reference of the purchase:

Intellectual property

Everything on the UNIVERS NUMERIQUES sites, with the exception of the graphic engines used for the games, which are the exclusive property of the GAME CONSULTING corporation, is and shall remain the exclusive intellectual property of UNIVERS NUMERIQUES. The Client is authorized only to install and use a single copy of the program downloaded onto one computer. It is generally accepted, however, that the main user may make a second copy, for safekeeping or storage. The Client does not have the right to sell, transfer or rent it. The Client is not authorized to exploit, disseminate or use in any way whatsoever, even in part, anything featured on the UNIVERS NUMERIQUES sites, be it software, video or audio content.
